Topeka, Kan.

April 26, 2023 – The Born Alive Infant Protection Act (H.B. 2313) ensures that infants born alive from failed abortions will receive appropriate medical care. The Senate voted 31-9 and the House voted 87-37 to override Governor Kelly’s veto of this Act. It will now become law.

Brittany Jones, Director of Policy and Engagement, Kansas Family Voice:

“Every year, children are born alive after failed abortions. These children deserve to be recognized and deserve to be afforded appropriate medical care. Neither the state or federal laws provide robust protection for these babies, nor do they explicitly lay out what kind of care the baby should receive.

Just because these children were not intended by the abortionists to be born alive, it does not mean they do not deserve the legal protections and the medical care that we would afford to any other living child. Kansans know this, and today, the Kansas Legislature ensured that no child will die alone in a closet without consequences. We are so thankful for the bipartisan supermajority that voted to protect these vulnerable children.”
