Topeka, Kan. —January 28, 2026 — Kansas lawmakers passed Senate Bill 244, a measure designed to strengthen the state’s Women’s Bill of Rights by restoring clear, consistent definitions of sex in Kansas law and ensuring that women and girls have access to private, secure, sex-specific spaces in public buildings. It passed the House 87-36 and the Senate 30-9.
S.B. 244 provides statewide clarity for agencies, schools, and public institutions by clarifying that the use of “sex” and “gender” in statute is defined by biology. The bill also establishes clear expectations for the designation of multiple‑occupancy restrooms, locker rooms, and changing areas in public buildings, ensuring these spaces remain reserved for one sex only.

- Establishes a uniform definition of gender & sex as biological sex for the purposes of Kansas law.

“S.B. 244 is about clarity, safety, and dignity. Kansas families, schools, and state agencies deserve laws that are consistent and enforceable. This bill ensures that women’s privacy is protected and that administrators have the guidance they need to comply with state law.
This bill does not change existing access to single‑occupancy facilities and does not restrict anyone from using private, individual restrooms. Instead, it restores long‑standing expectations for shared spaces where privacy and safety are paramount.
Kansas women and girls deserve spaces where their dignity is respected. S.B. 244 reinforces the truth that biological sex matters in certain contexts and ensures that our laws reflect that reality.
The bill also provides legal clarity for courts and privacy for all women in Kansas. By passing S.B. 244 the Kansas legislature has clarified it’s legislative intent in the Women’s Bill of Rights and ensured legal protections for women’s private spaces.”
S.B. 244 now goes to the Governor’s desks.
